By accessing or using Plum Media, you agree to these Terms.

Plum Media provides AI-powered services for creating, scheduling, managing, and publishing social media content.

The Company does not guarantee business outcomes including growth, engagement, lead generation, sales, or revenue.

Users must be at least 18 years old to create an account or use Plum Media.

By creating an account, the user represents that they meet this age requirement and are legally capable of entering into these Terms.

Users must provide accurate information and maintain the security of their accounts and connected platforms.

Users are responsible for all activity conducted through their account.

If an account is created on behalf of a business or organization, the individual creating the account represents that they are authorized to act on behalf of that business or organization.

Users agree to:

• Provide accurate information
• Maintain account credentials securely
• Upload only content they are authorized to use
• Comply with applicable laws and platform policies
• Review generated content before approval and publishing

Users may not:

• Use the Platform for unlawful activities
• Upload infringing, defamatory, misleading, or harmful content
• Interfere with Platform operations
• Reverse engineer or misuse services
• Publish spam, deceptive, or malicious content

Users may not use the Platform to create, request, upload, generate, distribute, or publish content that:

• violates applicable laws or regulations;
• infringes intellectual property or privacy rights;
• contains unlawful, defamatory, abusive, deceptive, hateful, or harmful material;
• contains obscene, sexually explicit, exploitative, or otherwise prohibited content;
• attempts to circumvent safeguards, moderation systems, or platform restrictions.

Users are solely responsible for prompts, inputs, uploaded materials, generated outputs, approvals, and content published through the Platform.

Plum Media uses third-party artificial intelligence technologies, models, and services, including services provided by OpenAI, Anthropic, Google, and fal.ai, to assist with content generation and other automated Platform features.

Depending on the features used, information submitted through the Platform may be processed by these third-party AI services. Such information may include business information, product or service information, brand information, uploaded content, prompts, instructions, preferences, website information, images, and other inputs necessary to provide the relevant Platform feature.

The availability, performance, processing practices, retention, security, and handling of information by third-party AI providers may be subject to their respective terms, privacy policies, and applicable service agreements.

The Company does not independently review or guarantee all generated outputs and does not endorse generated content solely because it was produced through the Platform.

Kivion Industries LLP reserves the right to restrict, suspend, remove, reject, or terminate access where content or usage is reasonably believed to violate these Terms, applicable laws, third-party provider policies, or community standards.

The Company shall not be responsible for claims, losses, penalties, disputes, or damages arising from user-generated requests, user-provided inputs, or user-approved AI-generated outputs, except where liability cannot legally be excluded.

Users retain ownership of materials they provide.

Users grant the Company a limited, non-exclusive licence to access, process, reproduce, transmit, store, modify, and otherwise use submitted materials solely as reasonably necessary to operate, maintain, provide, secure, and deliver the Platform and its features, including AI-assisted content generation, scheduling, publishing, storage, security, and related functionality.

This licence does not transfer ownership of the user's submitted materials to the Company.

Users represent and warrant that they own, have obtained, or otherwise possess all rights, licenses, permissions, and authorizations necessary for any materials, content, trademarks, logos, images, videos, text, product information, or other assets submitted to or used through the Platform.

Users are solely responsible for ensuring that content created, approved, scheduled, or published through the Platform does not infringe or violate any intellectual property rights, copyrights, trademarks, publicity rights, or other rights of third parties.

Where content is generated, modified, scheduled, or published using Platform features, user approval of such content shall constitute confirmation that the user has reviewed and authorized publication.

Kivion Industries LLP and Plum Media shall not be liable for claims, notices, takedowns, damages, penalties, disputes, or losses arising from copyright infringement or intellectual property violations resulting from user-provided materials, user instructions, or user-approved content.

The Company reserves the right to remove, suspend, refuse publication of, or disable access to content reasonably believed to violate applicable laws or third-party rights.

Plum Media uses AI-assisted systems to help create content more efficiently and consistently.

While we aim to generate relevant and high-quality content, generated outputs may require user review before publication to ensure alignment with business requirements, factual accuracy, regulatory obligations, product specifications, and brand expectations.

Users remain responsible for approving content before publishing. User approval confirms that the content is suitable for publication based on the user’s business requirements.

The Company continuously improves generation quality but does not guarantee specific business outcomes from generated content.

Where content previews, drafts, approval workflows, or publishing confirmations are provided, users are responsible for reviewing and approving content prior to publication.

Once content is approved by the user, such approval shall constitute confirmation that the content is acceptable for publication.

The user assumes responsibility for the approved content, including its accuracy, claims, legality, compliance obligations, and suitability for publication.

The Company shall not be responsible for liabilities, claims, losses, penalties, or damages resulting from content approved by the user before posting, except where liability cannot legally be excluded.

By connecting accounts and enabling publishing features, users authorize the Company to publish approved content on their behalf using permissions granted through connected services.

Users may revoke access at any time by disconnecting integrations or terminating use of the Platform.

Plum Media integrates with third-party platforms and services to enable content publishing and related functionality.

While the Company works to maintain reliable integrations and publishing workflows, certain actions and outcomes remain controlled by third-party platforms, including changes to APIs, content moderation decisions, account restrictions, publishing limitations, service interruptions, reach distribution, or account policies.

The Company is not responsible for independent actions taken by third-party platforms. Users remain responsible for ensuring that their accounts and published content comply with applicable third-party platform requirements and policies.

Where Plum Media offers a free trial, the applicable trial duration and features will be communicated to the user at the time of signup.

Where a payment method is required to start a free trial, the user authorizes Plum Media and its payment provider to charge the applicable subscription fee and taxes automatically when the free trial ends, unless the subscription is cancelled before the end of the trial period.

The subscription will continue to renew automatically according to the selected billing cycle until cancelled.

Users may cancel the subscription through the available cancellation process before the trial ends or before the next renewal date, as applicable, to prevent the applicable future charge.

By starting a free trial that requires payment information, the user acknowledges and agrees to these automatic billing and renewal terms.

Access to certain features of the Platform may require an active paid subscription under the selected plan.

Users authorize the Company to charge applicable subscription fees and any applicable taxes in accordance with the selected billing cycle and pricing in effect at the time of purchase or renewal. Subscriptions remain active until cancelled.

Failure to make timely payment, payment reversal, chargeback, failed billing authorization, or suspected fraudulent payment activity may result in suspension, restriction, downgrade, or termination of access to the Platform without prior notice.

Unless expressly stated otherwise in writing, all payments are final and non-refundable, including for partially used subscription periods, unused credits, unused posting capacity, early cancellation, dissatisfaction with business outcomes, or reduced usage.

The Company reserves the right to revise pricing, subscription features, usage limits, or plan structures at any time. Changes will apply prospectively and continued use after such changes constitutes acceptance of the updated pricing or subscription terms. Where such changes affect existing paid subscriptions, the Company will provide users with at least thirty (30) days' prior notice through email, account notification, website notice, or other reasonable communication channels.

Subscriptions are billed in advance for each billing cycle and remain active until cancelled.

Users may cancel their subscription at any time through the available cancellation process provided by the Platform.

Cancellation will prevent future renewals but will not affect the current active billing period. Access to paid features will continue until the end of the already paid subscription term unless otherwise specified.

No partial refunds, prorated refunds, or credits shall be provided for unused time, unused services, reduced usage, early cancellation, or remaining days in an active billing cycle unless expressly stated otherwise by the Company.

To avoid being charged for the next billing cycle, users must cancel before the renewal date applicable to their subscription.

The Platform is provided on an “as available” basis. Continuous availability or error-free operation is not guaranteed.

To the maximum extent permitted by applicable law, Kivion Industries LLP and Plum Media shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings arising from or relating to the use of or inability to use the Platform.

To the maximum extent permitted by applicable law, the aggregate liability of Kivion Industries LLP and Plum Media arising out of or relating to the Platform or these Terms shall not exceed the total subscription fees actually paid by the user to Plum Media during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable law, the courts located in Delhi, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms, the Platform, or the services provided by Plum Media.

Nothing in this section prevents a user from exercising any rights or pursuing any remedies that cannot lawfully be restricted by an agreement regarding jurisdiction.

To the maximum extent permitted by applicable law, the user agrees to indemnify, defend, and hold harmless Kivion Industries LLP, Plum Media, and their respective directors, officers, employees, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses, including reasonable legal fees, arising out of or relating to:

• materials, content, information, instructions, or other inputs provided by the user;
• content generated, approved, scheduled, or published through the user's account;
• the user's violation of these Terms or applicable law;
• the user's infringement or alleged infringement of any third-party intellectual property, privacy, publicity, or other rights; or
• the user's use or misuse of the Platform.

This indemnification obligation does not apply to the extent that a claim results from Plum Media's own fraud, wilful misconduct, or liability that cannot legally be excluded or limited.

We may suspend or terminate accounts for violations of these Terms.

Users may discontinue use or cancel according to available account procedures.

We may update these Terms periodically. Continued use following updates constitutes acceptance.
